ARGH!!! they still haven't fixed my dishwasher!

At the first of the year the motor in my dishwasher gave out.  Maintenance (I live in an apartment) was unable to fix it and b/c of its age they replaced it with a brand new dishwasher.  I've had nothing but problem after problem after problem.  We had black nasty stinky water fill up our sink; we had brown nasty stinky water fill the dishwasher and actually flood out onto the floor.  They sent a plumber out recently b/c a pipe under the sink had a whole in it and when they went to saw off an old pipe so it could be replaced the whole thing broke off and we went without a kitchen sink or dishwasher for very full, very long 2 days (almost 3).  Had the pipe not broken off they would never have notice how clogged it was -- a 2 or 2 1/2 inch pipe clogged to having only a 1/2 inch opening.  Today they told my husband that everything was all fixed and to go ahead and use the dishwasher.  Well... it stinks.  Very foul.  I figured it was leftover nasty water and the thing should be cleaned.  Poured a coffee mug full of vinegar and placed it right side up in the dishwasher.  Ran it on "water saver" mode and noticed a weird smell -- like plastic burning.  I opened the door and the heater coil thing was SMOKING!!!  I'm soooooooooooo over it.  I'm so so so so so so so over it.  I just want it fixed.  And if they can't fix it, I want a permanant discount on my rent payment.  FRUSTRATION!!!!!!!

    Buy paper plates & mugs.

    Call Apt. Management.

    Pour a drink for yourself.

Consider yourself hugged from me. You have been through way too much.

Is there any way that you could hire it done right and then take it out of the rent?

I wouldn't even think of doing that without talking with a lawyer first. The rent payment is fixed by contract and cannot be altered without both party's consent without some legal maneuvering such as an escrow account to demonstrate that the renter is not trying to avoid his/her responsibility.

If there is a landlord/tenant affairs office in the local govt. I'd go there after talking with the management one more time. Failing that, the only other legal remedy is to sue the landlord for nonperformance on their end of the contract. Or, if you're now in a month-to-month rental, pack your bags and move.

There is such a thing as a "constructive eviction" if the property is is such bad shape that it is uninhabitable or unsafe, but ultimately the definitions of those terms are jury questions.

OMG y'all!!!  The PLUMBER -- the CONTRACTED PLUMBER -- didn't turn the water on to the dishwasher!  I actually said to him, "So it's all good now?  I have a kitchen sink?  I can use the dishwasher?"  He said yes, so I went about trying to use it.  No wonder there were so many problems.  *sigh*  Well, I ran a load with just a cup of vinegar and it smells soooo much better now.  No more handwashing!!!

I'm going to have to just zip my lips here because my mama said "if you can't say anything nice, don't say anything at all".
